Terms of Service

1. Agreement to Terms

By accessing or using the Street Data Pro platform ("Service"), operated by Street Data Pro LLC ("Company," "we," "us," or "our"), located at 30 N Gould St Ste R, Sheridan, WY 82801, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age to access or use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. The Service is available only for lawful purposes. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Description of Service

Street Data Pro provides AI-verified property data intelligence services, including but not limited to:

• Distressed property scouting with AI-verified vacancy and distress confirmation via Street View imagery analysis
• Skip tracing services — Tier 1 (credit bureau data: phone numbers, relatives, deceased flags) and Tier 2 (budget skip trace: phone numbers, emails, current addresses, LLC resolution)
• Custom list processing and data enrichment

Data is delivered electronically in CSV format. All data is compiled from publicly available government records (county GIS parcel data) and third-party data providers.

4. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

5. Subscriptions, Search Credits, and Payment

All orders are processed through Stripe, our third-party payment processor. By subscribing or placing an order, you agree to:

• Subscription Plans: Plans provide a monthly allotment of search credits. Each search credit is consumed per property checked by our AI system. All properties scanned are included in your delivery results with full AI evaluation.
• Overage Charges: If you exceed your included search credits in a billing period, overage charges apply at the rate specified by your plan. Overages are billed at the end of your billing cycle.
• Skip Trace Add-On: Skip tracing (Tier 1 or Tier 2) is an optional add-on charged separately from search credits. Tier 1 is charged per found contact. Tier 2 is charged per record searched.
• Recurring Billing: Subscriptions are billed monthly and will automatically renew on the same date each month until you cancel. You can cancel anytime from your dashboard with no cancellation fees.
• Pricing: All prices are listed in US Dollars and are subject to change. Current pricing is displayed at the time of order. We will provide notice of pricing changes to active subscribers.
• Payment: Payment is required via credit card, debit card, or other accepted payment methods through Stripe.
• All Sales Final: ALL SALES ARE FINAL. Due to the nature of digital data products, no refunds, credits, chargebacks, or exchanges will be issued. By placing an order, you acknowledge and accept this policy.

6. Non-FCRA Compliance

IMPORTANT: THE DATA PROVIDED THROUGH THIS SERVICE IS NOT A "CONSUMER REPORT" AS DEFINED BY THE FAIR CREDIT REPORTING ACT ("FCRA"), 15 U.S.C. § 1681 ET SEQ. The data and services provided by Street Data Pro are not FCRA-compliant and may not be used, in whole or in part, for the following purposes:

• Employment screening or hiring decisions
• Tenant screening or rental decisions
• Credit eligibility or credit decisions
• Insurance underwriting
• Any other purpose regulated by the FCRA

By using the Service, you represent and warrant that you will not use any data obtained through the Service for any FCRA-regulated purpose. You are solely responsible for ensuring your use of the data complies with all applicable laws. Street Data Pro is not a consumer reporting agency and does not provide consumer reports.

7. Data Accuracy, Results Disclaimer, and No Guarantees

While we use advanced AI verification (including Street View imagery analysis and GIS data) to provide high-quality results, WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA PROVIDED. Specifically:

• Property vacancy and distress status is determined by AI analysis and may not reflect real-time conditions
• Skip trace results (phone numbers, emails, relative data) are sourced from third-party databases and may contain outdated, inaccurate, or disconnected information
• Phone numbers provided may be wrong numbers, disconnected, reassigned, or belong to a different person
• Owner name and mailing address data is sourced from county GIS records and may not be current
• Data is provided "as-is" and "as-available" without warranty of any kind, express or implied

NO GUARANTEE OF PROFITS OR RESULTS: STREET DATA PRO MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING YOUR POTENTIAL EARNINGS, PROFITS, OR FINANCIAL RESULTS FROM USING THE SERVICE OR ANY DATA OBTAINED THROUGH THE SERVICE. WE DO NOT GUARANTEE THAT YOU WILL MAKE MONEY. WE DO NOT GUARANTEE THAT ANY LEADS, CONTACTS, OR DATA WILL RESULT IN CLOSED DEALS, SUCCESSFUL TRANSACTIONS, OR ANY PARTICULAR OUTCOME. YOUR RESULTS DEPEND ENTIRELY ON YOUR OWN EFFORTS, SKILLS, MARKET CONDITIONS, AND NUMEROUS OTHER FACTORS BEYOND OUR CONTROL. ANY EXAMPLES OF POTENTIAL SAVINGS OR RESULTS ON OUR WEBSITE ARE FOR ILLUSTRATIVE PURPOSES ONLY AND ARE NOT GUARANTEES.

8. We Do Not Sell Your Data

Street Data Pro does not sell, share, trade, or distribute your personal information, account data, uploaded files, or any data you provide to us to any third party for marketing or commercial purposes. Your uploaded CSV files are used solely for the purpose of providing skip trace and data enrichment services as requested by you. We do not monetize your data in any way beyond providing the services you have paid for.

9. SMS Consent and Communications

By providing your phone number and opting in to receive text messages from Street Data Pro, you consent to receive SMS/MMS communications including order confirmations, account notifications, and service updates. Message and data rates may apply. Message frequency varies based on account activity.

• You may opt out of SMS communications at any time by replying "STOP" to any message.
• You may request help by replying "HELP" to any message.
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
• Carriers are not liable for delayed or undelivered messages.

10. Prohibited Activities

You agree NOT to use the Service to:

• Violate any federal, state, or local law, including the Telephone Consumer Protection Act (TCPA), Fair Debt Collection Practices Act (FDCPA), or any applicable Do-Not-Call regulations
• Engage in any unlawful, fraudulent, or malicious activity
• Harass, stalk, threaten, or intimidate any individual
• Use data for any purpose regulated by the FCRA (see Section 6)
• Resell, redistribute, or sublicense data obtained through the Service without written consent
• Use automated systems (bots, scrapers) to access the Service
• Attempt to reverse-engineer our AI verification processes or proprietary algorithms
• Upload malicious files or data intended to disrupt the Service
• Attempt to gain unauthorized access to other users' accounts or our systems
• Take any action that disrupts the performance, security, or availability of the Service

Compliance: You are solely responsible for ensuring your use of any data obtained through the Service complies with all applicable federal, state, and local laws. This includes compliance with TCPA regulations when contacting property owners via phone.

11. Intellectual Property

All content on the Street Data Pro website, including its design, logos, AI models, algorithms, scoring methodologies, and proprietary processes, is the property of Street Data Pro LLC and protected by applicable copyright, trademark, and intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without express written permission.

Data delivered to you may be used for your internal business purposes only, subject to the restrictions in Section 10.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREET DATA PRO LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

WITHOUT LIMITING THE FOREGOING, STREET DATA PRO LLC SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR CLAIMS ARISING FROM:

• Inaccurate, outdated, or incomplete phone numbers, email addresses, or contact data
• Calls or messages made to wrong numbers, disconnected numbers, or numbers belonging to persons other than the intended contact
• Any claims, fines, or penalties under the TCPA, FDCPA, FCRA, or any other federal, state, or local regulation arising from your use of data obtained through the Service
• Failed deals, lost opportunities, or any financial losses resulting from reliance on data provided
• Any actions taken by third parties you contact using data from the Service
• Inaccurate relative or associated person data
• Service interruptions, downtime, or unavailability

YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF ANY DATA OBTAINED THROUGH THE SERVICE. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Assumption of Risk

BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• Real estate investing, wholesaling, and related activities carry inherent financial risks
• The data provided is a tool to assist your business, not a guarantee of any outcome
• You are solely responsible for verifying all data before taking action, including making calls, sending mail, or entering into any transaction
• You are solely responsible for compliance with all applicable laws when using phone numbers and contact data, including but not limited to the TCPA, state-level telemarketing laws, and Do-Not-Call regulations
• Street Data Pro LLC is a data provider only and is not responsible for how you use the data
• You will not hold Street Data Pro LLC liable for any losses, damages, fines, penalties, or legal actions that result from your use of the data

14. Indemnification

You agree to indemnify, defend, and hold harmless Street Data Pro LLC, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or your violation of any applicable law.

15. Third-Party Services

The Service integrates with third-party providers including but not limited to:

• Stripe for payment processing
• Supabase for authentication and data storage
• Google for OAuth authentication and Street View imagery
• Anthropic for AI-powered property analysis

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of any third-party provider.

16. California Consumer Privacy Rights

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:

• Right to Know: You may request information about the categories and specific pieces of personal information we have collected about you.
• Right to Delete: You may request deletion of your personal information, subject to certain legal exceptions.
• Right to Opt-Out: You may opt out of the sale or sharing of your personal information. Note: Street Data Pro does not sell your personal information (see Section 8).
• Right to Correct: You may request correction of inaccurate personal information.
• Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

17. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately. Any data previously delivered to you remains subject to the usage restrictions in these Terms.

18. Modifications to Terms

We reserve the right to modify these Terms at any time without advance notice. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Sheridan County, Wyoming.
